**Field and Bay Equipment Use Waiver**
I, the intended guest, hereby acknowledge and agree to the terms and conditions outlined in this Equipment Use Waiver ("Waiver") for the use of electric bikes (e-bikes) and snowshoes provided by Field and Bay.
1. Assumption of Risks:
I understand and acknowledge that the use of e-bikes and snowshoes involves inherent risks, including but not limited to the risk of injury or death. I voluntarily assume all such risks and responsibilities associated with the use of this equipment for myself and all guests under the booking I agreed to.
2. Equipment Use:
I agree to use the e-bikes and snowshoes in a safe and responsible manner. I will comply with all applicable laws and regulations, and I will use the equipment only for its intended purpose.
3. Safety Guidelines:
I will adhere to all safety guidelines provided by Field and Bay for the use of e-bikes and snowshoes. This includes wearing appropriate safety gear, following designated routes, and operating the equipment in a manner consistent with its design and purpose.
4. Condition of Equipment:
I acknowledge that I am responsible for inspecting the e-bikes and snowshoes before each use. If I notice any damage or defects, I will immediately report it to manager of Field and Bay.
5. Reporting Damages/Injuries:
In the event of any damage to the equipment or injuries sustained during use, I agree to report such incidents immediately to Field and Bay. Failure to report damages or injuries promptly may result in additional charges or legal action.
6. Liability Release:
I hereby release and discharge Field and Bay, its owners, employees, agents, and representatives from any and all claims, liabilities, actions, demands, costs, and expenses arising out of or in connection with the use of e-bikes and snowshoes, including but not limited to personal injuries, property damages, or death.
7. Assumption of Responsibility:
I understand and agree that I am solely responsible for any damages to the e-bikes and snowshoes during my use. I will bear the cost of repair or replacement for any damages caused by my actions.
8. Governing Law:
This Waiver shall be governed by and construed in accordance with the laws of the jurisdiction of Prince Edward Island in which Field and Bay is located.
By booking online, I acknowledge that I have read and understood the terms of this Equipment Use Waiver, and I voluntarily agree to be bound by its provisions.
